This privacy policy is designed to help Customers better understand the operations of collecting, processing, and using personal data collected from Customers. 

This privacy policy is an integral part of the Terms of Use as stipulated in the Application/Website of Santa Joint Stock Company (SantaPocket). By continuing to use the Application/Website, Customers commit to agreeing to this privacy policy and complying with the terms and conditions of the privacy policy.

1. Objectives and Information Gathering

The elements of data collection on the SantaPocket E-commerce trading platform include Phone number, Full name, Address, Email… Here is the information that SantaPocket needs members to provide when registering to use the service. and let SantaPocket confirm the link when customers register to use the service on the mobile application to ensure the rights of users.

SantaPocket does not collect personal information from individuals under the age of 18. Therefore, Customers will be responsible for the information provided, including information about others. SantaPocket trusts that Customers have taken necessary actions to obtain consent from others when providing their information and will not need to undertake any verification activities or assume any responsibility for the information provided by Customers.

1.1. Information Gathering:

Information gathering may be conducted directly or indirectly, in various forms and formats, without limitations on text, images, audio, written characters, etc., including but not limited to:

  1. Account information such as name, phone number, address, gender, date of birth, email, bank account…
  2. Browser information, time spent on the Application
  3. Transaction history, actions performed by Customers on the Application, including delivery and receipt locations, delivery and receipt times, and corresponding financial activities related to transactions
  4. Chat history, conversations that occur when Customers contact Santa to discuss specific situations
  5. Other information, data according to each feature within the Application

1.2. Purpose of Gathering:

  1. Identify and authenticate the customer’s identity.
  2. Log in to the SantaPocket application to use services. Meanwhile, send notifications about sending and receiving activities among members through the Application.
  3. Manage and operate SantaPocket service provision activities, including messaging reminders about registered delivery/receipt activities.
  4. Performing survey and analysis activities.
  5. Conduct surveys, and evaluate the results of System activities in the past period.
  6. Make a list of customers to implement promotional events or have separate policies for loyal customers.
  7. Carry out customer care actions, and improve service quality, including resolving situations that arise during customer application experience and service usage.
  8. Prevent activities that destroy user accounts of members or impersonation activities of Members.
  9. Contact to solve problems with members in specific situations.
  10. Do not use members’ personal information for purposes other than confirming and contacting related to transactions at SantaPocket.
  11. In case of legal requirements: SantaPocket is responsible for cooperating and complying with legal regulations as required.

In addition to the above purposes, Santa may collect data for specific purposes that Santa will notify specifically for each collection.

2. Storage Activities

2.1. Storage Location

The collected information will be stored in Santa’s management system with a commitment to security and customer information protection, utilizing advanced technology, including but not limited to:

  1. System security: Secure server systems employing advanced technology. Santa collaborates with strategic technology partners to continually update and optimize technology to ensure the integrity and security of information.
  2. Access management: Only Santa system employees have authorization to access the system for the purposes outlined above. Santa also emphasizes access hierarchy and permissions to ensure the highest level of integrity and security.
  3. Compliance with legal regulations: Updating legal regulations related to personal data protection.

Customer personal data may also be transferred, backed up, stored, and processed at Santa’s affiliated companies, and strategic technology units. Customers agree to this data transfer conditionally upon Santa’s assurance of compliance with the purposes of use as stipulated in this Privacy Policy.

2.2 Storage Time

Member’s data will be stored until the purposes are fulfilled or upon cancellation requests from Customers.

Upon request, Customer information will be deleted from Santa’s management system, except for storage required by law.

Departments within the company may be granted access to basic information to carry out their duties.

Third parties authorized to access customer data include companies with joint venture or affiliate relationships, or third parties such as:

  • Suga Corporation – A technology service provider, a strategic partner of Santa Joint Stock Company.
  • Combros LLC – A locker supplier, including software integrated with SantaPocket exclusive lockers of Santa Joint Stock Company.
  • Shipping service providers: to carry out delivery and receipt services using SantaPocket smart delivery lockers.
  • Payment service providers: partners related to payment processing, and refunds, including banks, credit organizations, organizations providing payment gateways, and E-wallets.
  • Partners related to sending and receiving notifications (SMS, email, calls).
  • Other third parties used by Santa to support the business activities of Santa Joint Stock Company, including but not limited to postal, telecommunications, advertising, media, event organizations… and others to fulfill the purposes mentioned in section 1.

4. Means and tools for users to access and correct their data

Members have the right to self-check, update, adjust, or cancel their personal information by logging into their account and correcting personal information or asking SantaPocket to do this. When receiving these feedbacks, SantaPocket will confirm the information and be responsible for replying and guiding members to restore or delete the personal information of customers.

5. Customer Rights:

  1. Access Right: Customers have the right to access all information related to themselves by logging into the Application.
  2. Editing Right: Customers have the right to edit any inaccurate or incomplete information, including updating old information.
  3. Right to Limit Processing of Personal Data: Customers have the right to restrict the processing of personal data without deleting data by legal regulations.
  4. Right to Withdraw Consent: If data processing has been previously consented to by the Customer, the Customer has the right to withdraw this consent at any time. However, this withdrawal does not affect the legality of the actions that Santa has taken before.
  5. Right to Complaint: Customers have the full right to complain if they discover that Santa is using their personal information for purposes not stated.

6. Customers’ privacy information security commitment 

SantaPocket is committed to ensuring absolute security for customer personal information according to SantaPocket’s privacy policy. Collection and use of customer information are only carried out with the customer’s consent, except in cases where other legal regulations apply.

Except for specific provisions in the policy, Santa does not use, transfer, provide, or disclose customer personal information to third parties without the customer’s consent. When SantaPocket needs to use or share customer information with a third party, SantaPocket will send an email or message to the customer to confirm whether they agree to SantaPocket using the information. If the customer agrees, they will respond via email or message to SantaPocket. If the customer does not respond within twenty-four (24) hours, SantaPocket will assume the customer has consented to the request.

In the event of a server storing information being hacked resulting in the loss of member personal data, SantaPocket will be responsible for notifying the authorities to promptly investigate and handle the incident, and informing the members.

SantaPocket commits to absolute security for all online transaction information of customers, including digitized accounting invoices, in the level 1 safe zone of SantaPocket’s secure central area.

Within 30 working days from the receipt of feedback, the company commits to taking technical and operational measures to verify, review, and address the customer’s feedback. SantaPocket pledges to compensate customers for damages when their information is not used for the intended purposes outlined in this Privacy Policy.

Santa has the right to refuse to resolve issues if the customer was initially dishonest in providing information and/or provided misleading information, leading to situations that arise later. 

Santa also has the right to amend and update the terms of this Privacy Policy. Any changes to Santa’s privacy policy will be notified on the Application/Website or via email. The customer’s continued access and use of the Application will be deemed as acceptance of and agreement to these changes.
